These Terms of Service ("Terms") are a binding agreement between you and Autofan SIA, a limited liability company incorporated under the laws of the Republic of Latvia, registration No. 50203100031, registered office Līvciema iela 9 k-1 – 11, Riga, Latvia ("Symbocar", "we", "us"). They govern your use of the Symbocar application, website, and mobile apps (together, the "Service").
By creating an account or using the Service you accept these Terms, our Privacy Policy, and the AI Disclosure. If you do not accept them, do not use the Service. If you register a business on the business portal, the Business Terms apply to that use in addition to, and in precedence over, these Terms.
1. The Service
Symbocar is a vehicle-maintenance companion. It lets you keep a digital service book for your vehicles; talk to Symbocar, our AI assistant (the "Assistant"), which provides vehicle-issue assistance, helps you find service and record an appointment, and manages your vehicle records on your instruction; receive proactive maintenance reminders; and connect independent repair shops to your vehicle record through a feature we call Service Connect (shops you have connected this way are "Connected Shops"), under permissions that you control.
The Service is currently provided free of charge to personal users. Section 12 explains how we would introduce paid features, if ever.
2. Eligibility
You must be at least 16 years old and legally capable of entering into this agreement. The Service is directed at users in the European Union / European Economic Area. If you use it from elsewhere, you do so on your own initiative and are responsible for local law compliance.
3. Your account
- Keep your credentials confidential. Actions taken through your authenticated account are attributed to you.
- Provide accurate information — in particular accurate vehicle data (make, model, year, VIN, mileage). The Assistant's guidance is only as good as the data you give it.
- Notify us without undue delay at julianserdjuk@gmail.com if you suspect unauthorized access to your account.
- One person per account. Do not impersonate anyone or misrepresent a vehicle's identity.
4. The Assistant — what it is and what it is not
Symbocar is an AI system. You are informed of this in the disclosure you accept at first login and in the persistent AI labeling in the chat interface, in accordance with Article 50 of Regulation (EU) 2024/1689 (the "AI Act"). The full disclosure is here.
4.1 Intended use. The Assistant provides informational decision support: vehicle-issue guidance presented as a hypothesis for your review, maintenance planning, appointment recording, and record management. It is designed and offered exclusively for that purpose.
4.2 What the Assistant is NOT. The Assistant is not: a substitute for a hands-on inspection, diagnosis, or repair by a qualified technician; a certified diagnostic instrument (its output has no legal, insurance, warranty, or regulatory evidentiary status); a substitute for the manufacturer's service manual or an OEM diagnostic tool; a provider of legal, financial, medical, or insurance advice; or an emergency service. In a road emergency, call the emergency services.
4.3 Your duty to verify — safety-critical rule. AI output can be wrong. For any guidance touching a safety-critical system — brakes, steering, suspension, fuel system, airbags, seatbelts, wheels/tyres — you must have the vehicle inspected by a qualified technician before continuing to drive. The Assistant may flag such cases in the conversation, but it does not guarantee to do so. If you act on safety-critical guidance without professional verification, you do so at your own risk, and Section 13 applies.
4.4 Records the Assistant writes. On your instruction, or automatically when it identifies an issue, the Assistant may write entries to your vehicle's health dashboard or service book. Every automatic entry can be reviewed and dismissed by you with one click — the Assistant cannot prevent this. No Assistant action produces legal or similarly significant effects on you within the meaning of Article 22 GDPR; the override paths are provided regardless (see the Privacy Policy).
5. Acceptable use
You must not:
- use the Service for any unlawful purpose;
- seek or attempt to elicit guidance on emissions-control tampering (DPF/EGR/catalyst removal or defeat), disabling safety systems (ABS, ESC, airbags, seatbelts, TPMS), VIN modification or cloning, or odometer tampering — the Service refuses these requests by design, and attempting to bypass those refusals is a material breach;
- use the Service to cause harm to any person or property;
- interfere with, probe, or disrupt the Service, its security measures, or its infrastructure, or access data of any other user;
- scrape the Service or extract our code, prompts, or datasets, or reverse-engineer the Service except to the extent such restriction is prohibited by mandatory law;
- submit content that is illegal, infringing, or that you have no right to submit.
6. Your content and data
Your vehicle data, service records, uploads, and chat content remain yours. You grant us a non-exclusive, worldwide license to host and process them solely to operate, secure, and improve the Service, as described in the Privacy Policy. Assistant output generated for you may be used by you freely; we claim no copyright in it. You are responsible for having the right to submit what you submit.
7. Connected Shops
- You control access. A shop only ever connects to your vehicle through flows you approve: entering a sync code you accept, approving a pushed service log, or granting Service Book access (read access to your service history, with cost and provider information withheld). The baseline connection only lets a shop propose service-log entries to you.
- Nothing enters your service book without you. A shop-pushed service log becomes part of your record only when you accept it. You may reject any push.
- Revocation. You may revoke any shop's access at any time in the app; revocation takes effect immediately for future access.
- Shops are independent businesses. Symbocar is a platform. We are not a party to, agent for, or guarantor of any repair, quotation, warranty, or other dealing between you and a shop. Claims about the quality, safety, price, or timeliness of a shop's work lie against the shop.
- Verification is a gate, not an endorsement. Our administrative screening of shops is a plausibility check for platform access only — not a background check, licensing confirmation, quality certification, or recommendation. Choose your shop with the same care you would off-platform.
8. Service availability
We aim to keep the Service available and correct. However, the Service is provided "as available": maintenance windows, third-party model or infrastructure outages, and force majeure may interrupt it. Your statutory conformity rights under Directive (EU) 2019/770 remain unaffected.
9. Intellectual property
The Service — including software, design, branding, templates, prompts, and documentation — is owned by Autofan SIA or its licensors. These Terms grant you a personal, non-transferable, revocable right to use the Service for its intended purpose; no other rights are granted.
10. Changes to the Service
We may improve, modify, or discontinue features. If a change materially reduces the core functionality described in Section 1, we will notify you in-app with reasonable advance notice, and you may terminate at any time.
11. Changes to these Terms
Material changes trigger a re-acceptance flow on your next login and take effect only after you accept, or 30 days after notice, whichever is earlier — except changes required by law or urgent security needs, which may take effect immediately. Non-material wording fixes do not require re-acceptance.
12. Price
The Service is free of charge for personal users today. If we introduce paid features: we will give at least 30 days' notice and obtain your express acceptance before you are charged anything; features you already use free of charge will not silently become paid; and statutory consumer rights applying to paid digital services (including withdrawal rights under Directive 2011/83/EU) will be honored from the first paid offering.
13. Liability
13.1 What we do not exclude. Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; damage caused intentionally or by gross negligence; liability under the mandatory product-liability regime (Directive (EU) 2024/2853 as implemented in national law); or any other liability that cannot be excluded or limited under the law of your country of residence.
13.2 Our commitment. We are liable, subject to Section 13.3, for damage caused by the Service failing to function as a reasonably careful user is entitled to expect given its stated intended use (Section 4.1), its stated limitations (Section 4.2), and the warnings shown to you in the conversation.
13.3 What we exclude and cap. To the extent permitted by mandatory law:
- Reliance without verification. We are not liable for damage resulting from acting on Assistant guidance concerning a safety-critical system without the professional verification required by Section 4.3, or from use of the Service outside its intended use.
- Third-party services. We are not liable for the acts, omissions, workmanship, or records of Connected Shops or for outages of third-party providers beyond our control.
- Inaccurate input. We are not liable for consequences of inaccurate or incomplete vehicle data supplied by you or a shop whose entry you accepted.
- Indirect loss. We are not liable for indirect or consequential loss, loss of profit, or loss of data that you could have prevented by using the export function we provide.
- Cap. For everything not listed in Section 13.1, our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to EUR 200.
13.4 Your statutory rights. If you are a consumer, these Terms do not deprive you of the protection of mandatory provisions of the law of your EU/EEA country of residence.
14. Term and termination
By you: delete your account at any time (Settings → Data → Delete account). Deletion is immediate and irreversible; the Privacy Policy (Section 7) describes exactly what is erased and what a shop's own records retain. By us: we may suspend or terminate your account on material breach of Section 5. Except where the breach is severe, unlawful, or a security risk, we will warn you and give you an opportunity to respond first. On termination we will, on request, make your data export available for 30 days unless legally prohibited.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Latvia. If you are a consumer resident in another EU/EEA country, you additionally enjoy the mandatory consumer protections of that country, and you may bring proceedings in your country of residence.

16. General
Language. These Terms are drafted in English. Translations are provided for convenience; the English version prevails to the extent permitted by law. Severability. If a provision is held invalid, the remainder stays in force. Assignment. You may not assign these Terms; we may assign them in a corporate reorganization, provided your rights are not reduced. Entire agreement. These Terms, the Privacy Policy, and the AI Disclosure are the entire agreement for personal use of the Service.
